Assalamu Alaikum,

I have been quite irritated with the mystery behind the Lockerbie bombing. I will not delve into speculation as to who could have been behind this...speculation without proof is easy. I thought that a certain ruler would provide evidence to show that Ali Megrahi was innocent and he said that the Scottish judges should either commit suicide, resign or (forgot the third one!). But we have seen no evidence, instead we saw some more anti-American slogans. This is not proof and the Scottish judges are quite happy with their verdict and as far as I know no one has committed suicide. Part of the problem in countries like Libya and many other Muslim countries is that their respective leaders enjoy the art of theatrics and are not capable of diplomacy nor statesmanship. Likewise, the intelligence services of these Muslim countries are appalling and third rate which is why the Libyans could not produce an iota of evidence to absolve Megrahi from any wrongdoing IF indeed he is innocent.

I have yet to read the judgement of the court case, so I cannot comment on the merits of the plaintiff or the defendent. But whoever is was behind the bombing of Pan Am 103 deserve the death penalty. Giving the criminal(s) life sentences out of our tax money so that they can be fed, watered, clothed, entertained etc. in prison is not justice and that I believe is one of the weaknesses in the Western judicial system. Political correctness has overshadowed the rationality behind the death penalty.

What the Lockerbie Trial has highlighted is that killing of innocent civilians (despite the fact that there were some CIA agents on board) has no place in a civilised society. As always, there is another side to the coin, the shooting down of an Iranian Airbus killing 290 people needs to be re-examined, since no one has taken responsibility, and justice has not been forthcoming for the relatives of those who were killed. Again, Iran only relies on empty sloganeering against the USA and nothing more.

Likewise when President Reagan bombed Tripoli innocent people, such as Qaddafi's daughter were killed. And this is another fallacy behind the Western concept of wartime justice. As far as I know, in a war situation the head of state of the enemy country cannot be killed. And we see the results, Saddam Hussain, Qaddafi, Milosovic are still alive and innocent people have died. No civilised society should tolerate the killing of people who have no say in what their leaders do.

I hope that the Lockerbie trial serves as a reminder to us that there are other similar cases where killers of innocent people have not be brought to trial. If Megrahi (and his accomplices) is guilty of bombing Pan Am 103, then he should deserve the death penalty.

Wassalam
Ali

Call to end Libya sanctions

A Scottish Labour MP is to call on the UK Government to resume contact with Libya - despite the Lockerbie trial verdict. Linlithgow MP Tam Dalyell will use a Commons debate on Tuesday morning to demand that sanctions are lifted.

Libyan agent Abdel Baset Ali Mohmed Al Megrahi was found guilty of the murders of the 270 victims of the Lockerbie bombing and sentenced to life in prison earlier this month.

He has lodged an appeal against his conviction at the special Scottish court in the Netherlands.
Tam Dalyell says sanctions should be lifted
His lawyers say there is nothing to prove that he carried out the bombing of Pam Am Flight 103, which exploded above the Scottish town in 1988.

And Mr Dalyell agrees with them, saying that he believes Al Megrahi is innocent.

He insists it is time sanctions against Libya are removed.

He will use the debate at Westminster to call on ministers to resume contact with the government in Tripoli.

The UK Government is limiting its comments until the appeal is concluded.

Sallaam brother Hasan here's an intresting article i found on this topic at http://www.khilafah.com

Justice Is Not The Word - Lockerbie

Justice is not a word synonymous with the capitalist West. The acquittal of the Los Angeles police in the Rodney King beating and the verdict in the O.J. Simpson are some of the cases that brought home the reality about the workings of the American justice system. The UK has also seen many of its own miscarriage-of-justice cases such as “The Guildford Four”, and the “Birmingham Six”. It appears that the Lockerbie trial will be yet another example.

Although the purpose of this article is not to determine guilt or innocence, the evidence against Abdul Basset Ali Megrahi is widely regarded as laughable. Such as the key charge against Megrahi that he caused a suitcase with explosives to be loaded at Malta airport, although there is no witness, no video, no document, no fingerprints, no evidence of any kind. And the court admits it: “The absence of any explanation of the method by which the primary suitcase might have been placed on board KM180 [Air Malta] is a major difficulty for the Crown case.”

Or the supposed identification of Megrahi ten years after the event by a storekeeper in Malta as the purchaser of the clothing found in the bomb suitcase. The same storekeeper that had earlier identified several other people as the culprit, including one who was a CIA agent.

As is often the case with the West, establishing justice is not the prime objective. Originally Iraq and Syria were the prime suspects of the U.S. government in the plane bombing. Until the Gulf War in 1990 came along and the support of Iran and Syria was needed, and Washington was anxious as well to achieve the release of American hostages held in Lebanon by groups close to Iran. Suddenly it was Libya, the Arab state least supportive of the US build-up to the Gulf War and the sanctions imposed against Iraq that was behind the bombing after all, declared Washington.

The same zeal shown by the Western nations to bring legal action against Libya was hypocritically absent in the shooting down of a civil Iranian aircraft by a US warship in 1988 in Iranian territorial waters. The Iranian Airbus was on a domestic flight using a regular air route when it was shot down in Iranian territorial waters on 3rd July 1988. All 290 civilians were killed.

The Americans claim they were in the Gulf to protect oil tankers from attacks resulting from the war between Iraq and Iran - even though America was supplying arms to both sides. However David Carlson - a captain of one of the American ships in the area said that the aircraft did not pose a threat to US ships in the area. Even though the Iranian aircraft continually broadcast its civilian status, Captain Rogers of the USS Vincennes was intent on ‘taking out’ the aircraft.

The Navy lied and misled an investigation by claiming that the aircraft was diving in an attack mode outside its correct air lane. They also failed to state that the USS Vincennes was in Iranian territorial waters when it shot down the Iranian plane and that the aircraft was shot down in Iran’s territorial waters. Indeed the wreckage was found within Iranian waters. The black box and cockpit voice recorder which could have revealed the truth and exposed the American Navy’s contradictory story, was never found. Because of the inconsistencies in the Navy’s story another investigation was carried out. In this investigation it was revealed that the USS Vincennes was known as ‘Robocruiser’ and had a ‘trigger happy reputation keen to see action’. The Captain of the Vincennes, Will Rogers was known as a man hungry for action.

The crew of the USS Vincennes received a heroes welcome at San Diego. The crew all received combat action ribbon for service in the Persian Gulf. So arrogant was the captain that he did not apologise for what he had done. To date, no one has been brought to trial or charged with their murder. Clearly as far as the West are concerned the death of Muslims is of no significance.

Such double standards are what the Muslims have come to expect. The injustice of the Capitalist West has cast its net far and wide in many shapes and forms. In the judicial process we usually find the prosecutor building a case based on circumstantial evidences, especially if there are no clear facts about the case. Usually both the defence and the prosecutor engage in negotiations and compromises in order to decide the verdict of the case. Many legal experts will attest to the fact that there are really no set rules in the judicial process. Statistics show that Black males, for example, usually get longer and more severe punishment than white males, for the same crime.

Only the Khilafah, a State built upon dispensing the Justice of Allah (SWT), can cut through it. Allah (SWT) says in the Quran, -in translation-“O you who believe: Stand out firmly for justice, as witnesses to Allah, even as against yourselves, or your parents, or your kin, and whether it be (against) rich or poor. For Allah can best protect both. Follow not the lusts (of your hearts), lest you swerve, and if you distort (justice), verily Allah is well-acquainted with what you do.”

Since the rules were made by the Legislator, Allah, no one escapes the justice of the law. Prophet Muhammad once told his dear beloved Fatimah that if she stole he would have her hand cut. There are no “presidential” pardons (as with Clinton and Marc Rich) if the Khalifah, a Wali, or the Qadee Mathalim commits a crime. Rather they are prosecuted to the full extent of the law. Prophet Muhammad (saw) ordered us saying: “If you see it as clear as the sun then give the testimony, otherwise abstain from it.”

oh yes, I forgot one other thing.

Whilst I believe that the Lockerbie issue has raised more questions than it has answered, it has highlighted similar unsolved cases where the Iranian aribus was shot down, as well as many other injustices we see against Muslims.

However, it is very sad that many brothers to not condemn Muslims who are involved in terrorism, by that I mean hijacking and killing innocent civilians..which are cowardly acts. One of my distant relatives was shot dead during a hijacking. Some of you may remember that during the 1980s, a Pan Am plane was about to take off from Karachi, but it's generator failed. The terrorists (don't know which Muslim group they belongd to) thought that they were caught and so they started firing point blank. One of their insidious bullets hit my relative and he died as a result. My thread was in the context of the death penalty and the West seems to think that it is a barbaric act. However people should realise that when people commit crimes of murder, it would be a good deterrent (although that would be disputed by liberals). I don't know if those Pan Am terrorists were caught, but I'd be the first to suggest that these b------s have their heads chopped off.

Why are there Muslim groups who are too cowardly to fight an army face to face, instead resort to killing innocent people? I believe this is a symptom of a lack of a political and military structure, and so these groups do their own things making what ever little impact they can.

Hasan
