The principle upon which the Islamic system is founded and without which it does not exist. If this principle is absent the whole system collapses, i.e. the Islamic rule collapses and vanishes and the authority of Islam disappears.

As for the first principle it is the sovereignty belongs to the Shari'ah; the principle has its factual evidence; it is the word sovereignty which is to Shari'ah and not to the Ummah. This word is in fact a Western definition, to describe someone exercising his will and conducting it. If an individual were exercising and controlling his own will, he would be sovereign over himself and if his will were controlled other than by himself he would be a servant; so is the case with the Ummah, if her will i.e. the bulk of the will of individuals were conducted and controlled by herself via some of her individuals, to whom she willingly and freely grants the right to control that will she would be considered sovereign over her own will, whereas if her will was controlled against her wishes she would be considered enslaved. That is why the democratic system says the sovereignty belongs to the people i.e. the people run their own affairs and elect their own delegates and deputies to run their affairs on their own behalf. This is the fact and reality of the sovereignty which we aim to shed the light on. This sovereignty belongs to the Shari'ah and not to the Ummah. The will of the individual is not conducted by himself as he pleases but by the commands and prohibitions of Allah (swt); and so is the case for the Ummah, she is not controlled by her own free will but subjected to the commands and prohibitions of Allah (swt). And evidence about this is reflected in Allah's saying:

"And by thy Lord they will not believe until they judge between them.." [4:65] and his Speech:

"O ye who believe, Obey Allah, Obey his Messenger and those in authority amongst you and if you differ then refer it to Allah and his Messenger if you believe in Allah and the Last Day." [4:59]

Referring it to Allah and the Messenger means to the rule of Shari'ah. The Messenger of Allah (saw) said: "None amongst you would believe until his desires would be in harmony with what I have been sent with." Therefore what controls and rules over the Ummah and the individual, and what conducts the will of the Ummah and the individual is in fact what the Messenger of Allah (saw) has brought. The Ummah and the individuals submit to the Shari'ah. Thus the sovereignty is for the Shari'ah. Therefore the Khaleefah is not given the bay'ah by the Ummah to be a hired man executing what she wishes as is the case in the democratic system; but he is given the bay'ah by the book of Allah and the Sunnah of his Messenger (saw), to execute the Book of Allah (swt) and the Sunnah of his Messenger (saw) i.e. to implement the Shari'ah and not what the people wish, therefore if the people who gave him the pledge deviated and violated the Shari'ah he would be obliged to fight them until they revert back to the Shari'ah.

bismil khaleqil noor,
assalamu alaikum,
there is a practical question with regards to the rule of shari'ah.
shariah is useless without the rule of man, as he is the one that puts laws from words to practice. how to we make sure that the ruler to whom bay'ah has been given will rule in accordance with shariah and at what point/how do we stop any deviations?
the reason i ask the question is due to the fact that in our history some of the khalifs, turned into despotic, kingstyle rulers and any opposition to them was seen as breaking bay'ah and deserving of punishment, while it was the ruler who was breakling the laws of shariah. examples of such khalifs could be found in ummayads, eg yazid and the massacre of imam hussain a.s. in karbala, the attack on kaa'ba by his commanders and the burning of kaa'ba, the attack on madina by him and all due to the uprising of the people against his despotic rule. there are many more incidents and khalifs, eg abbassis, othmanis etc.
therefore, it is very important to devise a system that turn slogans into good practice and has a safety valve to stop any despotism in the name of being a khalif.
wasalam,
mahdi

That is very true brother mahdi. We must make sure that who ever we select or elect to rule us does so in accordance with the prophetic teachings and the fear of Allah and that they do no deviate as soon as they smell power and authority, as have been done by many in the past

Pakistan is also independent from Bangladesh...which fool would accept the creation of a state that is divided by another nation, the so-called enemy nation, India...
